Terms of Service

1. Service Description

TrackHIPAA ("we," "our," or "the Service") is a web-based software platform that helps small healthcare practices generate HIPAA compliance documentation, track compliance status, and access regulatory guidance. The Service includes customized policy generation, security risk assessment tools, employee training tracking, vendor and Business Associate Agreement management, breach response workflows, an AI-powered compliance assistant ("AI Oracle"), and audit-ready document export.

2. Important Disclaimer — Not Legal Advice

TrackHIPAA is a compliance documentation tool. It is not a law firm, does not employ attorneys, and does not provide legal advice. All content generated by the Service, including outputs from the AI Oracle, is based on published federal regulations, HHS guidance, and official government sources. This content is provided for informational and educational purposes only.

The AI Oracle uses artificial intelligence to answer HIPAA-related questions using a curated knowledge base of verified government sources. While we strive for accuracy, AI-generated responses may contain errors or may not reflect the most recent regulatory changes. You should not rely on any output from the Service as a substitute for professional legal counsel. We strongly recommend consulting a qualified healthcare attorney for legal questions specific to your situation.

3. Eligibility and Account Responsibility

You must be at least 18 years old and authorized to act on behalf of your healthcare practice to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payment Terms

TrackHIPAA is offered as a monthly subscription at $49 per month. All payments are processed through LemonSqueezy, our third-party payment provider. By subscribing, you authorize recurring monthly charges until you cancel.

  • There are no long-term contracts. You may cancel at any time.
  • Cancellation takes effect at the end of the current billing period. You will retain access until that period ends.
  • We do not offer prorated refunds for partial billing periods.
  • We reserve the right to change pricing with 30 days' advance notice. Price changes will apply to the next billing cycle following the notice period.

5. Cancellation Policy

You may cancel your subscription at any time from your account settings or by contacting us at support@trackhipaa.com. Upon cancellation, your subscription remains active through the end of the current billing cycle. After that, you will lose access to premium features, but any documents you have previously downloaded remain yours to keep.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
  • Upload any protected health information (PHI) or patient data to the Service. TrackHIPAA stores practice profile information only and is not designed to handle PHI.
  • Attempt to reverse-engineer, decompile, or extract the source code or underlying algorithms of the Service.
  • Share, resell, or redistribute generated documents to third parties outside your practice.
  • Use automated systems or bots to access the Service in a manner that exceeds reasonable use.

7. Intellectual Property

Documents generated by the Service are customized for your practice and may be used by you for your internal compliance purposes. The underlying templates, algorithms, knowledge base, and software remain the intellectual property of TrackHIPAA. You may not reproduce, distribute, or create derivative works from the Service itself.

8. Data Handling

TrackHIPAA stores your practice profile information (practice name, type, state, employee count, systems used, and similar operational details) to customize your compliance documents. We do not store, process, or have access to any protected health information (PHI) or patient data. For full details on how we handle your data, please review our Privacy Policy.

9. Service Availability

We aim to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.

10. Limitation of Liability

To the maximum extent permitted by applicable law, TrackHIPAA and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service.

TrackHIPAA does not guarantee that use of the Service will result in HIPAA compliance or a favorable outcome in any regulatory audit, investigation, or enforcement action. Compliance is ultimately the responsibility of the covered entity. Our total liability for any claim arising from these Terms or your use of the Service shall not exceed the amount you paid to us in the three (3) months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless TrackHIPAA and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any applicable law or regulation.

12. Modifications to Terms

We reserve the right to update these Terms at any time. If we make material changes, we will notify you by email or through the Service at least 30 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
